Il tuo ordine non è confermato finché 5tate of Mind non ne conferma l'accettazione. Prima di accettare un ordine dobbiamo ricevere ed elaborare il pagamento. Ti preghiamo di controllare attentamente l'ordine prima dell'invio, poiché 5tate of Mind potrebbe non essere in grado di soddisfare le richieste di annullamento di un ordine dopo l'accettazione. In caso di rifiuto, modifica o annullamento di un ordine, ti avviseremo contattandoti tramite l'email, l'indirizzo di fatturazione e/o il numero di telefono da te forniti al momento dell'invio dell'ordine.
I tuoi acquisti sono soggetti a reso o cambio esclusivamente in conformità alla nostra Informativa sui rimborsi [LINK].
Dichiari e garantisci di effettuare acquisti per uso personale o familiare e non per la rivendita o l'esportazione.

SEZIONE 4 - PREZZI E FATTURAZIONE

I prezzi pubblicati nei nostri negozi online potrebbero differire dai prezzi offerti nei negozi fisici o online o in altri negozi gestiti da terze parti. Di tanto in tanto possiamo proporre offerte sui Servizi che influenzino i prezzi e che sono soggette a termini e condizioni indipendenti dai presenti Termini. In caso di conflitto tra i termini di un'offerta e i presenti Termini, prevarranno i termini dell'offerta.
Per tutti gli acquisti effettuati nei nostri negozi, accetti di fornire dati corretti, aggiornati e completi relativi ad acquisto, pagamento e account. Accetti di aggiornare immediatamente il tuo account e altre informazioni, compresi l'indirizzo email e i numeri e le date di scadenza delle carte di credito, al fine di consentirci di completare le tue transazioni e contattarti se necessario.

SEZIONE 5 - SPEDIZIONE E CONSEGNA
Non siamo responsabili dei ritardi nella spedizione e nella consegna. Tutti i tempi di consegna sono solo delle stime e non sono garantiti. Non siamo responsabili per i ritardi da ricondurre a corrieri di spedizione, procedure doganali o eventi fuori dal nostro controllo. Una volta trasferiti i prodotti al corriere, proprietà e rischio di smarrimento passano a te.

Non dovrai riprodurre, distribuire, modificare, creare copie, mostrare e presentare pubblicamente, ripubblicare, scaricare, conservare o trasmettere materiale relativo ai Servizi senza il nostro consenso scritto. Salvo quanto dichiarato espressamente, i presenti Termini non contengono nulla che garantisca o possa essere interpretato come a garanzia della licenza o di altri diritti a tuo favore relativamente a brevetti, marchio commerciale, copyright o altre proprietà intellettuali di 5tate of Mind, di Shopify o di terze parti. L'utilizzo non autorizzato dei Servizi può risultare in una violazione delle leggi federali e statali sulla proprietà intellettuale. I nomi, i loghi, i nomi dei prodotti e dei servizi, i design e gli slogan di 5tate of Mind sono marchi commerciali di 5tate of Mind o dei suoi affiliati o licenzianti. Il nome, il logo, i nomi dei prodotti e dei servizi, i design e gli slogan di Shopify sono marchi commerciali di Shopify. Tutti gli altri nomi, loghi, nomi dei prodotti e dei servizi, design e slogan presenti nei Servizi sono marchi commerciali dei loro rispettivi proprietari.

Potresti avere accesso agli strumenti per i clienti offerti da terze parti come parte dei Servizi e che noi non verifichiamo né controlliamo o inseriamo.
Comprendi e accetti che forniamo accesso a tali strumenti "così come sono" e "per quanto disponibili" senza alcun tipo di garanzia, presentazione o condizioni e senza alcun sostegno. Non abbiamo responsabilità derivante o relativa all'utilizzo da parte tua di strumenti facoltativi di terze parti.

5tate of Mind è gestito da Shopify, che ci consente di fornirti i Servizi. Tuttavia, le vendite e gli acquisti da te effettuati nel nostro Negozio avvengono direttamente con 5tate of Mind. Utilizzando i Servizi comprendi e accetti che Shopify non è responsabile per alcun aspetto delle vendite tra te e 5tate of Mind, compresi eventuali lesioni, danni o perdite derivanti dall'acquisto di prodotti e servizi. Sollevi espressamente Shopify e i suoi affiliati da tutti i reclami, i danni e le responsabilità derivanti o relativi agli acquisti e alle transazioni da te effettuati con 5tate of Mind.

Poiché supporta i Servizi, Shopify raccoglie ed elabora i dati personali relativi all'accesso e all'utilizzo dei Servizi da parte tua per offrire e migliorare i Servizi per te. Al fine di offrire e migliorare i Servizi per te, i dati che invii ai Servizi saranno trasmessi e condivisi con Shopify e terze parti che potrebbero risiedere in paesi diversi dal tuo. Ci riserviamo il diritto di sospendere, disabilitare o chiudere il tuo account in qualsiasi momento, senza preavviso, qualora ritenessimo che tu abbia violato una qualsiasi parte dei presenti Termini.

SEZIONE 14 - RISOLUZIONE
Possiamo risolvere in qualsiasi momento il presente accordo o interrompere il tuo accesso ai Servizi (o a qualsiasi parte di essi) a nostra discrezione e senza preavviso; continuerai ad avere la responsabilità di tutti gli importi dovuti fino alla data della risoluzione.
Le seguenti sezioni continueranno a essere valide dopo la risoluzione: Proprietà intellettuale, Feedback, Risoluzione, Limitazione di garanzia, Limitazione di responsabilità, Risarcimento, Scindibilità, Rinuncia, Intero accordo, Assegnazione, Leggi applicabili, Informativa sulla privacy e qualsiasi altra clausola che, per la propria natura, duri oltre la risoluzione.

SALVO QUANTO ESPRESSAMENTE DICHIARATO DA 5tate of Mind, I SERVIZI E TUTTI I PRODOTTI OFFERTI TRAMITE ESSI SONO FORNITI "COSÌ COME SONO" E "PER QUANTO DISPONIBILI" PER L'UTILIZZO DA PARTE TUA, SENZA ALCUN TIPO DI RAPPRESENTAZIONI, GARANZIE O CONDIZIONI, ESPLICITE O IMPLICITE, COMPRESE LE GARANZIE O LE CONDIZIONI IMPLICITE DI COMMERCIABILITÀ, QUALITÀ DEL SERVIZIO, IDONEITÀ A UNO SCOPO SPECIFICO, DURATA, TITOLO E ASSENZA DI VIOLAZIONI. NON GARANTIAMO, RAPPRESENTIAMO NÉ ASSICURIAMO CHE L'UTILIZZO DEI SERVIZI DA PARTE TUA SARÀ PRIVO DI INTERRUZIONI, PUNTUALE, SICURO E PRIVO DI ERRORI. ALCUNE GIURISDIZIONI POTREBBERO LIMITARE O VIETARE LA LIBERATORIA DI GARANZIE IMPLICITE O DI ALTRE GARANZIE, DUNQUE LA SUDDETTA LIBERATORIA POTREBBE NON ESSERE VALIDA PER TE.

SEZIONE 16 - LIMITAZIONE DI RESPONSABILITÀ
NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE, IN NESSUN CASO 5tate of Mind, I PARTNER, DIRIGENTI, FUNZIONARI, IMPIEGATI, AFFILIATI, AGENTI, COMMERCIANTI, FORNITORI DI SERVIZI O LICENZIANTI NOSTRI O DI SHOPIFY E DEI SUOI AFFILIATI, SONO RESPONSABILI PER EVENTUALI LESIONI, PERDITE, RECLAMI O DANNI DIRETTI, INDIRETTI, ACCIDENTALI, PUNITIVI, SPECIALI O CONSEQUENZIALI DI NESSUN TIPO, COMPRESO MA NON LIMITATO A PROFITTI PERSI, ENTRATE PERSE, GUADAGNI PERSI, PERDITA DI DATI, COSTI DI SOSTITUZIONE O ALTRI DANNI SIMILI, CHE DERIVINO DA RESPONSABILITÀ CONTRATTUALI, PARTICOLARI, DI ILLECITO (COMPRESA LA NEGLIGENZA) O DERIVANTI DALL'UTILIZZO DA PARTE TUA DEI SERVIZI O DEI PRODOTTI OTTENUTI TRAMITE I SERVIZI; NÈ PER ALTRI RECLAMI RELATIVI ALL'UTILIZZO DEI SERVIZI O DEI PRODOTTI DA PARTE TUA, COMPRESO MA NON LIMITATO A EVENTUALI ERRORI O OMISSIONI NEI CONTENUTI, EVENTUALI PERDITE O DANNI DI QUALSIASI TIPO RISULTANTI DALL'UTILIZZO DEI SERVIZI O DEI CONTENUTI (O PRODOTTI) PUBBLICATI, TRASMESSI O RESI DISPONIBILI IN ALTRO MODO TRAMITE I SERVIZI, A PRESCINDERE DALL'AVVISO DI TALE EVENTUALITÀ.

SEZIONE 17 - RISARCIMENTO
Accetti di risarcire, difendere e proteggere 5tate of Mind, Shopify e i nostri affiliati, partner, funzionari, dirigenti, impiegati, agenti, commercianti, licenzianti e fornitori di servizi da eventuali perdite, danni, responsabilità o reclami, incluse le ragionevoli spese legali da corrispondere a qualsiasi terza parte in conseguenza: (1) alla violazione da parte tua dei presenti Termini e condizioni dei Servizi o dei documenti in essi contenuti, (2) alla violazione da parte tua delle leggi o dei diritti di terze parti, (3) all'accesso e all'utilizzo dei Servizi da parte tua.
Ti notificheremo eventuali reclami risarcibili, posto che la notifica non immediata non ti solleva dai tuoi obblighi a meno che tu non sia materialmente influenzato. Potremmo controllare la difesa e la definizione di tale reclamo a tue spese, compresa la scelta del consiglio, ma non definiremo reclami che richiedano obblighi non economici da parte tua senza il tuo consenso (che non potrà non essere accordato senza ragionevole motivo). Collaborerai in difesa dei reclami non risarciti, anche fornendo documenti rilevanti.

SEZIONE 18 - SCINDIBILITÀ
Nel caso in cui qualsiasi clausola dei presenti Termini e condizioni del servizio sia ritenuta illegale, nulla o inapplicabile, non sarà applicabile neanche nella misura consentita dalla legge in vigore, e sarà valutata la scissione della parte inapplicabile dai presenti Termini e condizioni del servizio, tale decisione non influirà sulla validità e l'applicabilità delle altre restanti clausole.

SEZIONE 19 - RINUNCIA; INTERO ACCORDO
Il mancato esercizio o applicazione da parte di Shopify di qualsiasi diritto o clausola dei presenti Termini e condizioni del servizio non costituirà una rinuncia a tale diritto o clausola.
I presenti Termini e condizioni del servizio e qualsiasi informativa o norma operativa pubblicati da noi su questo sito o relativi ai Servizi costituiscono l'intero accordo e la comprensione tra noi e te, e regolano l'utilizzo dei Servizi da parte tua, sostituendo qualsiasi accordo, comunicazione e proposta precedenti o contemporanei, sia orali che scritti, tra noi e te (compreso ma non limitato a qualsiasi versione precedente dei Termini e condizioni del servizio).
Eventuali ambiguità nell'interpretazione dei presenti Termini e condizioni del servizio non sono da intendersi contro la parte stipulante.

SEZIONE 20 - ASSEGNAZIONE
Non devi delegare, trasferire o assegnare il presente Accordo né alcuno dei tuoi diritti o obblighi soggetti ai presenti Termini senza il nostro consenso scritto; qualsiasi tentativo sarà vano e nullo. Potremmo trasferire, assegnare o delegare i presenti Termini e i nostri diritti e obblighi senza avvisarti o senza il tuo consenso.

SEZIONE 21 - LEGGI APPLICABILI
I presenti Termini e condizioni del servizio e qualsiasi accordo separato secondo cui ti forniamo i Servizi deve essere gestito e interpretato ai sensi dei tribunali federali, statali o territoriali nella giurisdizione in cui ha sede 5tate of Mind. Tu e 5tate of Mind accettate la sede e la giurisdizione personale nei suddetti tribunali.

SEZIONE 22 - TITOLI
I titoli utilizzati nel presente accordo sono inclusi solo per comodità e non limitano né influenzano i presenti Termini.

SEZIONE 23 - MODIFICHE AI TERMINI E CONDIZIONI DEL SERVIZIO
